Dr Howcare Sdn. Bhd., its subsidiaries, branches and controlled entities (collectively referred to as the “Company”) is committed to respecting and protecting the privacy of all persons who access and/or register with the Company on www.drhow.com.my   (“Website”) and mobile application DrHow (“Application”) (“user”, “you” or “your”). 

The Company as an operator of the Website and Application only provides a platform to enable you to communicate, schedule appointments with participating third party medical practitioners and healthcare professionals (collectively referred to as the “Healthcare Providers”). 

This Privacy Policy sets out how the Company collects, uses and protects your personal data which you have provided to the Company on this Website and/or Application. By accessing this Website and/or Application or registering and/or using any of the Services on this Website and/or Application, you hereby consent to the processing of your personal data by the Company in the provision of Services that you have requested through this Website and/or Application.

This Privacy Policy shall only apply to the Services provided by the Company via this Website and/or Application. This Privacy Policy becomes effective as soon as you access this Website and/or Application or register and/or use any of the Services on this Website and/or Application, you agree to be bound by this Privacy Policy. 

You acknowledge and agree that your attending Healthcare Providers may have privacy standard and/or policies in regard to the use and disclosure of your medical information. Hence, you understand that you will accordingly be subject to that particular Healthcare Providers’ own privacy standard and/or policies in respect to the services rendered by the Healthcare Providers.

In this Privacy Policy, save and except where the context otherwise requires, words denoting the singular include the plural and vice versa, words denoting any gender include all genders.


1.	COLLECTION OF PERSONAL DATA

1.1	By accessing or using this Website and/or Application, you shall provide  “Personal Data” to the Company including but not limited to your name, age, date of birth, gender, nationality, place of birth, contact details, residential and/or correspondence address, email address, National Registration Identity Card number or passport number, birth certificate number, marital status, photographs, images and/or videos, payment details including but not limited to bank account and/or debit/credit card information, any information that you have provided in the registration form, application form or any other similar forms, any information about you which has been or may be collected, stored, used and processed by the Company from time to time including sensitive personal data (as defined under the Personal Data Protection Act 2010) such as physical or mental health information, religious data, criminal data and etc.

1.2	In respect to the provision of personal data of a minor, you verify that you are the parent or guardian of such minor and you have the necessary authority and consent to provide such personal data upon your usage of the Services provided in this Website or Application.

1.3	The provision of your personal data is voluntary and not obligatory. However, such personal data is necessary in the provision of the Services to you by the Company and in connection with the purposes stated below. 


2.	PURPOSE OF PROCESSING OF PERSONAL DATA

2.1	By accessing this Website and/or Application or registering and/or using any of the Services on this Website and/or Application, you hereby agree and consent to the using and processing of your personal data by the Company, in the manner and for the purposes as described below: -

(i)	For any other purpose that is ancillary to or in furtherance of these above purposes or required by law or any regulatory authorities or the Company has your permission to do so.

2.2	You acknowledge you have voluntarily supplied all personal data to the Company. However, in the event you do not wish to provide your personal data to the Company, you understand and agree that the Company may not be able to provide you the services you request or may require.


3.	DISCLOSURE OF PERSONAL DATA

3.1	Your personal data provided to the Company or obtained by the Company shall be kept confidential. However, it may be necessary for the Company to engage third parties, service providers or individuals to perform certain services on the behalf of the Company. In such event, you hereby agree and consent that the Company may disclose and transfer your personal data to the third parties, within or outside Malaysia, including without limitation, as follows:-

(a)	Employees of the Company;

(b)	Healthcare Providers, partners, agents, contractors, third party service providers who advertises, provide services or facilities in connection with this Website and/or Application, the Company or those who have contractual agreements with us;

(c)	Financial institutions, insurers (including those located outside of Malaysia), employers, third party payors, credit card and payment gateway companies;

(d)	Any other person to whom disclosure is required in order to protect or defend our rights and/or property; and

(e)	Other parties authorized or consented by you.

3.2	Our mobile application shall also disclose and transfer the information to any statutory bodies, regulatory bodies and/or governmental authorities where legally required to do so.


4.	THIRD PARTY SITES OR PROVIDERS

4.1	This Website and/or Application may contain links to websites or applications operated and maintained by third parties such as Healthcare Providers, partners and/or advertisers, over which we have no control. You acknowledge that your access to these third party sites and/or applications is at your own risk and that the privacy standard and/or policies of such third party sites and/or applications are independent from the Company. The Company shall not be responsible for any information submitted by you to third party sites and/or application. You should read and review the privacy standard and/or policies such third party sites and/or applications before disclosing any personal information.


5.	PROTECTION OF PERSONAL DATA

5.1	The Company takes necessary security and technical measures to protect the security and confidentiality of personal data in compliance with applicable law. During transmission and upon receipt of personal data, the Company employs generally accepted industry standards to protect the personal data submitted to the Company. In the unlikely event of a breach of privacy, the Company shall notify you as soon as practicable.


6.	REQUEST FOR ACCESS AND INQUIRIES

6.1	You may at any time hereafter request for access to, or request for rectification or correction of your personal data (subject to payment of fees, if applicable), or limit the processing of your personal data by the Company, as the case may be, however subject to the exceptions and restrictions as may be contained under the applicable law. 6.2	Please note that the Company has the right to refuse your request to access and/or make any correction to your personal data to the extent permitted under the applicable law.

7.	OPTING OUT

7.1	You can opt out of receiving marketing communications from the Company at any time by using the "Unsubscribe" link in each newsletter or communication, or by accessing your account created on this Website and/or Application. It may take up to fourteen (14) days for the records and systems to be updated in regard to your opting out.

7.2	Even if you have opted out from receiving marketing communication, the Company may still contact you for other purposes in relation to the transactions or the services you have requested from the Company.


8.	GENERAL

8.1	The Company hereby reserves the right to vary and/or amend this Privacy Policy at any time as it deems fit. Such variation and/or amendment shall be effective upon the posting of the updated Privacy Policy on this Website and/or Application. Your continued access to the Website and/or Application shall constitute your agreement and consent to the updated Privacy Policy and you agree that it is your responsibility to review the updated Privacy Policy.

8.2	This Privacy Policy is issued in languages of (i) English, (ii) Bahasa Malaysia and (iii) Chinese. In the event of any inconsistencies or discrepancies among the three versions, the English version shall prevail.
